PRICE QUOTES

We are ETX Travel and we look forward to the opportunity to act as your booking agent for your travel needs. Access to and use of the services of ETX Travel(“ETX” and/or “our”) and our website is subject to acceptance of these terms and conditions (“Terms and Conditions”). By accessing, using or obtaining any content, products, or services through our offices or through our website, you, the purchaser and/or traveler (“Customer” and “passenger” and “you/your”) agree to be bound by these terms.

 

PLEASE READ THE TERMS BEFORE USING OUR WEBSITE. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS YOU DO NOT AGREE WITH, PLEASE DO NOT USE OUR WEBSITE OR ETX Travel. No alterations to these terms and conditions may be made by any ETX Travel authorized representative or agent, unless in writing by an authorized officer of ETX Travel.  ETX Travel is an Independent Agency.

Price quotes for travel are not guaranteed until reservations are confirmed with full passenger names and deposit payment. Quotes on airfare are not confirmed until paid in full and can change without notice. All prices are subject to change without notice and are subject to availability. Unless otherwise noted, price quotes typically do not include airfare, baggage fees, gratuities, meals, telephone calls, resort fees, incidental items, souvenirs, airport transfers or travel insurance.

PAYMENTS AND CANCELLATIONS

Unless otherwise defined during the reservation process, final payment is due prior to departure or consumption in accordance with each supplier’s (airline, hotel, cruise line, transfer company, sightseeing operators, and other travel service vendors) terms and conditions involved in your travel booking. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. In some cases, there is NO REFUND once a booking is made and paid for. Your right to a refund if you change or cancel your travel plans is limited. All cancellation requests must be sent to ETX Travel in the form of an email. As a result of cancellation ETX Travel and third party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, each supplier’s websites. Cancellation penalties are advised at time of booking and provided to you upon confirmation. If you have any questions, or any penalties are unclear, please contact your ETX Travel Travel Consultant. Cancellation fees will be charged to the credit card you authorized to pay for travel services. ETX Travel's cancellation fees are separate from vendor cancellation fees. Vendor policies regarding cancellation fees will be relayed to all clients in your trip quote documents.

​CHANGE FEES

If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Due to Vendor(s) policy(ies) or time restraint(s), certain bookings may not be changed. All desired changes must be sent via email to ETX Travel.

TRAVEL INSURANCE

Travel insurance is strongly recommended. It may be purchased, which may cover cancellation for covered reasons as outlined in the insurance policy. Insurance policies vary with differing exclusions (such as pre-existing conditions, work related issues, supplier bankruptcy, change of mind, etc).

REQUIRED IDENTIFICATION

Photo identification is required for all travel. Passports are required for international travel and some countries require a visa. Travelers will not be permitted to depart without the proper identification. It is the traveler’s responsibility to verify and obtain any required identification prior to travel commencing. Please check with your U.S. Department of State for more information related to your travel destination. Special documentation is required for minor children traveling with or without their parents. If traveling with children, please check with the supplier before departure for any specific policies or restrictions. Non U.S. citizens must contact the consulate of any countries you are visiting to verify any visa requirements. Non – U.S. citizens residing in the U.S. must also contact the U.S. Citizenship and Immigration Services for re-entry requirements into the U.S.

TRAVEL DOCUMENTS

Once received by ETX Travel, travel documents are hand delivered locally or electronically. Otherwise, they are sent via US Postal Services, UPS or FedEx. For late bookings and rebooking, or if expedited delivery of documents is necessary, a $25 shipping fee will apply. We check all documents prior to delivery; please check your documents to confirm accuracy of all information. Call us immediately at (512)775-3877 if any errors are found. Tickets and vouchers are negotiable instruments – keep them in a safe place at all times. Lost, stolen, or destroyed tickets/vouchers cannot be replaced or refunded

AIRLINE CONFIRMATION, CHECK-IN, SEAT ASSIGNMENTS, MISSED FLIGHTS

It is important that you confirm your flights with the airline prior to departure: 24 hours in advance for domestic flights, and 72 hours in advance for international flights. Failure to confirm international flights or failure to use any portion of an airline reservation may result in automatic cancellation by the airline for all continuing and return flights. Familiarize yourself with your airline’s policies and requirements before booking. Unless stated otherwise by the airlines, it is important to arrive at the airport at least 2 hours prior to departure for domestic flights and 3 hours prior to departure for international flights. Late arrival at the airport can result in loss of assigned seats or denial of boarding. Denial of boarding is not eligible for refund or travel insurance reimbursement. Airfare rebooking is subject to airline penalties, rebooking fees, plus any cost difference of the new flight. Seat assignments are subject to change by the airline without notice.

DISCLAIMER OF LIABILITY

 All prices are thought to be accurate, available, and current. The information, products, and services may include inaccuracies or typographical errors. ETX Travel does not guarantee the accuracy of, and disclaims liability for inaccuracies, including by not limited to the price, information, and description of the products and services described on this website. ETX Travel is not liable for any errors made by the client creating their own bookings online. By booking online clients take full responsibility for any errors that may occur (name misspellings, incorrect travel dates, etc.). ETX Travel is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any supplier, or personal injuries, death, property damage or other damages or expenses resulting from causes outside of the control of ETX Travel. ETX Travel shall not be responsible for travel delays or cancellations or any illness, death, injury, damage or loss of vacation time arising there from. Changes to cruise ports of call or itineraries due to mechanical, weather, or world events beyond our control are at the sole discretion of the cruise line and may occur without notice. Any applicable compensation resulting from such occurrences is also at the sole discretion of the supplier. ETX Travel shall not be liable for any injuries, damages, or losses incurred by the traveler in connection with, or by supplier employees or contractors, terrorist activities, social or labor unrest, mechanical or construction failures, or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside of the control of ETX Travel. The Traveler assume the complete and full responsibility for checking and verifying any and all passport, visa, inoculations, or other entry requirements for each destination as well as re-entry into the U.S., and all safety or security conditions at such destinations, in connection with the proposed travel. For information concerning possible dangers at international destinations, check the Travel Advisory Section of the U.S. Department of State website.

 

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is a contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention (cdc.gov/coronavirus/2019-nCoV/), senior citizens and Guests with underlying medical conditions are especially vulnerable. 

By traveling you voluntarily assume all risks related to exposure to COVID-19.

MODIFICATIONS TO THE SITES

Passport Online reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Sites (or any part thereof) with or without notice. GRAPHIC AND TEXTUAL CONTENT

Graphic and textual content included with or originating from Passport Online and its associated products may be via direct ownership control or licensed by or to Passport Online, Inc. Use and re-distribution of this content outside of Passport Online and its associated products is expressly prohibited unless specifically authorized in writing.


DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

b. PASSPORT ONLINE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE SITES WILL MEET YOUR REQUIREMENTS; (ii) THE SITES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITES WILL BE ACCURATE OR RELIABLE; AND (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITES WILL MEET YOUR EXPECTATIONS.

c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITES IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PASSPORT ONLINE OR THROUGH OR FROM THE SITES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT PASSPORT ONLINE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF PASSPORT ONLINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).

EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Passport Online may provide you with notices, including those regarding changes to the TOS, by posting a revised TOS on this site (http://www.passportonlineinc.com).

TRADEMARK INFORMATION

The Passport Online trademarks and service marks and other Passport Online logos and product and service names are trademarks of Passport Online (the "Passport Online Marks"). Without Passport Online's prior permission, you agree not to display or use in any manner the Passport Online Marks.

GENERAL INFORMATION

Entire Agreement. The TOS constitutes the entire agreement between you and Passport Online and governs your use of the Sites, superseding any prior agreements between you and Passport Online with respect to the Sites.

Choice of Law and Forum. The TOS and the relationship between you and Passport Online shall be governed by the laws of the State of Oregon without regard to its conflict of law provisions. You and Passport Online agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Multnomah County, Oregon.

Waiver and Severability of Terms. The failure of Passport Online to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.
